‘No Evidence Of Conspiracy’: Aryan Khan Bail Order Out, Court Finds Nothing Objectionable


After holding star kid Aryan Khan in custody for 25 days, with relentless media intrusion on the matter, several denied appeals for bail and hours of investigation as well as conspiracy theories hitting the news every single day, on October 28th Shah Rukh Khan’s son was finally granted bail

It was the first breakthrough for the celebrity family since October 3rd which is when Aryan Khan, along with Arbaaz Merchant and model Munmun Dhamecha, was arrested following a raid by NCB on a cruise party in Mumbai.

And now it seems like Aryan Khan and his family have another reason to heave a sigh of relief as Bombay High Court said there is “hardly any positive evidence” to show any sign of conspiracy between the accused as alleged by the Narcotics Control Bureau (NCB) earlier.

The order, that is said to be 14 pages long, was made available on Saturday afternoon and clearly mentioned how there was "nothing objectionable found in the WhatsApp chats" to suspect a conspiracy between Aryan Khan, Arbaaz Merchant or Munmun Dhamecha. 

The court also acknowledged that just the fact that the three were travelling in the same cruise cannot, by itself, be a foundation for the charge of conspiracy against them.

As far as the confessional statements recorded by the NCB of the three accused is concerned, Bombay High Court called it ‘non-binding’ and dismissed its claim. It observed, “Such confessional statements are not having any binding effect in law" keeping in mind a 2013 Supreme Court judgment.

The court further observed how the three accused, “were not even subjected to medical examination so as to determine whether at the relevant time, they had consumed drugs.”

The 14 page-long order also upheld the fact there was indeed an “absence of material record" to infer any or all three as part of a criminal conspiracy as well as citing that nothing objectionable was found on their phones or their WhatsApp chats.

It therefore remarked, “There is hardly any positive evidence on record to convince this Court that all the accused persons with common intention agreed to commit unlawful acts. Rather the investigation carried out till this date suggests that Applicant/Accused nos. 1 & 2 (Aryan and Merchant) were travelling independent of Applicant/Accused no. 3 (Dhamecha) and there was no meeting of minds on the aforesaid issue.”
