The Bombay High Court put a partial stay order on one of the provisions of the IT Rules, 2021Β and said that the wide termsΒ βbring about a chilling effect on the Right to Freedom of Speech.β The order was passed by a bench of Chief Justice Dipankar Dutta and Justice GS Kulkarni in a petition filed by The Leaflet and journalist Nikhil Waghle.Β
The petition has challenged theΒ Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and called them βunconstitutional.' The new IT rules came into effect earlier this year and the new guidelines have to be followed by social media websites and digital news outlets.Β
Β© Reuters
The High Court stayed Rule 9(I) and 9(III) of the IT rules which mandates digital news outlets to adhere to a code of ethics and set up a regulatory mechanism that includes an oversight role for the central government. This directly affects the freedom of the press which many critics have called unconstitutional.Β
The High Court agreed with the petition that the new Information Technology Act does not grant power to the central government to regulate news media. The court said that publishers are bound to rules of journalistic conduct of the Press Council of India under the Press Council Act and the Programme Code of the Cable Television Network Act. Even in these acts, a publisher or a journalist is not punishable, the high court said.Β
βIt is prima facie difficult to comprehend as to how such fields which stand occupied by independent legislations can be brought within the purview of the impugned rules and substantive action can be taken for their violation under the impugned rules. However, adherence and/or observance of moral standards in the code has been exalted to the status of a mandatory compliance. One who violates the code does so at his own peril and would expose himself/itself to more rigorous action than what the PCI Act envisages," the court said.

The court also pointed out the βchilling effectβ the new IT rulesΒ can have on digital news outlets if not stayed. Dissent or healthy criticism is a part of democracy which the new IT rules do not encourage news outlets to do. The court said breaking these rules would make anyone think twice before criticising people in public life. The court also called the new rules the βSword of Damoclesβ hanging over writers who may not be defaming anyone or even violating any law.
βA democracy would thrive only if the people of India regulate their conduct in accordance with the preambular promise that they took while giving to themselves the Constitution. Liberty of thought is one of such promises,β the court said.
The High Court said that if certain parts of the new IT Rules are not stayed, it would have a βpernicious effectβ and would generate fear for violating the new code of ethics rules.
βPeople would be starved of the liberty of thought and feel suffocated to exercise their right of freedom of speech and expression if they are made to live in present times of content regulation on the internet with the code of ethics hanging over their head as the Sword of Damocles.β
After staying Rule 9(1) and Rule 9(3) of the IT Rules, 2021, the court will now take the case for hearing on September 27th.Β

Day 4 of the second Test between India and England was looking to be absolutely gloomy and disappointing for the touring side after losing the top three batsmen for a total of 55 runs and within 24 overs.
However, thanks to a surprising performance by two of the highly criticised batsmen of the team, Ajinkya Rahane and Cheteshwar Pujara managed to stitch a 100-run partnership in the middle to bring a ray of hope to the Men in Blue at the Lordβs cricket ground.

Nonetheless, even Pujara and Rahane fell in quick succession with less than fours over apart and the dark clouds once again with the high chances of the second Test slipping out of their hands on the final day began surrounding them once again.
Amid all this, the fans of the Indian cricket team were rather surprised to see their captain Virat Kohli abusing and taunting his rival and leader of Englandβs bowling attack James Anderson while standing at the non-strikerβs end.

βYou're swearing at me again, are you? This isnβt your fu**ing backyard,β Kohli yelled at the 39-year-old bowler who dismissed him on a golden duck during the first Test at Trent Bridge. βChirp chirp chirp. This is what old age makes you,β Kohliβs voice got picked up by the stump microphones.
Agreed that Anderson responded to the Indian skipper with a few words of his own, and might even have started the whole fiasco in the first place. However, fans believe that when someone schools another person like Anderson did Kohli, he has got the right to trash talk. On the other hand, if you are the one to get schooled, you should not be the one with the big mouth.
Hereβs how they reacted to the verbal battle between the two giants:
Let your bat do the talking. Despite his age, he is delivering match winning performance which you fail to do so.

β Naveen Nayak (@NaveenNayak6) August 15, 2021While this incident took place in the 17th over, Kohli would go on to lose his wicket once again to an outer edge in the next seven overs, once again leaving the pitch on a disappointing note while only adding 20 runs to his teamβs cause.
Day 4 ended with India at 181/6 with a lead of 154 runs and with Rishabh Pant and Ishant Sharma on strike ahead of the final day of the match.

Day 4 of the second Test between India and England at Lordβs quickly became controversial after two of the cricketers from the hosting side were caught on camera doing something extremely dodgy which many consider to be a clear case of ball tampering.Β
In the 35th over of Indiaβs second innings of the match, which was being bowled by pacer Ollie Robinson, two of the English fielders could be seen kicking and stepping on the match ball with their spike shoes because picking it up and throwing it back to the bowler.
Whatβs is this Ball Tampering Umpires and Refree Sleeping ?#IndvsEng #Balltempering @sachin_rt @cricketaakash @WasimJaffer14 @YUVSTRONG12 @imVkohli @BCCI @ICC @ECB_cricket pic.twitter.com/owOwOlkfiX
β Prashant Rathore (@HonestPrashant) August 15, 2021
The video which was captured by the cameraman at the prestigious cricket ground shows one of the fielders directing the ball towards his teammate with his foot as the other stepped on it with sharp spikes at the bottom of his shoes.
And while the viewers who were watching the unimaginable unfold right in front of their eyes were convinced that whatever was happening wasnβt right, England bowler Stuart Broad was continuously backing up his teammates while giving multiple explanations for the occurrence.
My comments are- Woody tried to nut meg Burnsy by tapping the ball through his legs (a very common occurrence) & he missed and kicked the ball there by accident. Instead of screenshotting the pic, watch the video- quite plain & easy to see

Depends If it was damaged? Exactly the same if it was hit into the stands. If it didnβt make a mark, why change it ?

βDepends If it was damaged? Exactly the same if it was hit into the stands. If it didnβt make a mark, why change it ?β Broad replied to another who had raised a valid point about the match referees and the umpires failing to step in and take control of the situation and probably replace it with an untampered ball, even if it was unintentional.
Nonetheless, Broadβs justification for what had happened failed to reassure the fans of the Men in Blue who very openly expressed their dissent online:
So that's how you try to pass the ball by pressing the spike against it!!
Well done.. pic.twitter.com/FcaNf7pQ2C

β Bharat Patel (@mailbppatel) August 15, 2021Next time , once a ball is dead we can throw the ball into the stands to get it roughened a bit and term it as a genuine mistake
β AD (@cricadharsh) August 15, 2021@StuartBroad8 hitting in stands and playing with spikes are two different things...
Just like drinking on ur off days and drinking in dressing room when u r playing match...!!@ICC @BCCI
β A A (@aasinha26) August 15, 2021Broad, who played in the first Test at Trent Bridge, Nottingham, was eventually ruled out for the remainder of the series after being diagnosed with a calf injury.Β
Day 4 ended with India leading by 154 runs but having lost six wickets already. With Rishabh Pant on one end and Ishant Sharma on the other, the southpawβs ability to play a patient innings will be tested on the final day of the match.
