ISLAMABAD: The government has decided to take legal action against judge Waqar Ahmed Seth over his controversial observation in the detailed judgment of the high treason case sentencing former military dictator Pervez Musharraf to death. Federal Law Minister Farogh Naseem said, during a press conference, that the federal government has decided to file a reference at the Supreme Judicial Council against Justice Waqar Seth for his observation in paragraph 66 of the case. READ MORE: Musharraf treason case: All evidence points to crime of high treason, court says "He has written that we direct all law enforcement agencies to arrest Musharraf and punish him according to the law. He has further written that if he is found dead, his corpse be dragged to D-Chowk and hanged for three days," said Naseem. "I do not understand what need the judge had to give such an observation," he said, referring to paragraph 66 of the verdict in which the court ordered law enforcement agencies to hang his body for three days at the D-Chowk if he is found dead. The law minister said that Justice Waqar was 'unfit'. "By giving such an observation, Justice Waqar has proven that he is mentally unfit," said Naseem. "I would like to request the Supreme Court to stop the judge from working." The law minister raised a question on the judge's ability to discharge justice in light of his observation of paragraph 66. "He (judge Seth) is incompetent and should be restrained from discharging any administrative or judicial duties immediately. We will move this reference with the Supreme Judicial Council very soon," he said. Federal government will appeal decision: Shahzad AkbarSpecial Assistant to the Prime Minister on Accountability Shahzad Akbar said that he felt ashamed after reading the controversial paragraph. "My head hung in shame after reading the detailed verdict," he said. Referring to the special court judge, he said,"You have also taken an oath to obey the law." Akbar said that it was a "very serious concern and a moment of reflection" as the cases of many other innocents were in the hands of the same judge. He said that the government had other "serious concerns" over the verdict. "The government has serious concerns. We think that others should also be included in this case," he said. "Based on these issues and deliberations, the government has decided to appeal the verdict." In response to Naseem's statement that the other judge hearing the same case had not agreed with paragraph 66, Akbar said:"Whoever wrote this observation is not a friend of Pakistan." Akbar said that the judge should have interpreted the law and not made a new one instead. "As a student of law, I feel ashamed," he said, referring to the paragraph. Akbar said that the verdict had flouted international laws. He said that it was important to find out how the controversial paragraph was inserted in the verdict. "The mode and manner in which this trial was conducted is suspicious," he said. "Trial in absentia cannot be conducted. However, we saw that it did take place," he added. He said that the verdict had made Pakistan a laughing stock in front of the whole country. Akbar said that the judge had spoiled the entire case by giving the judgement. "Should we take steps that cause institutions to clash with one another," he asked. Akbar said that the government had reservations about how the trial was conducted. He said that a fair trial of the former military dictator should have been held. High treason caseA special court court had sentenced Musharraf to death on Tuesday for imposing a state of emergency on November 3, 2007, adding that it had found him guilty of high treason in accordance with Article 6 of the Constitution of Pakistan. The detailed verdict of the court was issued earlier today (Thursday). Dismissing criticism of a trial conducted 'in haste', the special court in its detailed verdict stated that Musharraf had “been afforded more than his due share of fair trial” and “given every opportunity to defend himself”. The court further said that “the facts of the case are well documented” and “clearly demonstrate guilt on part of the accused”. "The trial of high treason is the requirement of the Constitution against those individuals who undermine or attempt to undermine the Constitution by any means," the judgement stated. "This Court after the presentation of undeniable, irrefutable and unimpeachable evidence by the prosecution against the accused reaches to the conclusion that indeed accused [Musharraf] is guilty and deserves exemplary punishment.

Director General Inter-Services Public Relations (ISPR) Maj Gen Asif Ghafoor said on Thursday that the fears of the armed forces have "proven true" after the special court issued its detailed verdict on the high treason case against Gen (retd) Pervez Musharraf. "The concerns expressed in response to the short verdict in the case against Musharraf have proven true today after the detailed verdict," Maj Gen Ghafoor said as he addressed the press at General Headquarters. READ MORE: Musharraf treason case: All evidence points to crime of high treason, court says The DG ISPR said that the words used in the verdict were "beyond humanity, religion and civilised behaviour". Responding to sections of the verdict criticising the army for political interference, he further said that Pakistan Army was "a responsible institution" and its soldiers "had taken an oath to protect the country". Maj Gen Asif Ghafoor said that for the armed forces, "the country comes first and the institution [of the army] later". Speaking about the gains made by Pakistan Army, ostensibly in the war against terrorism, Maj Gen Ghafoor said a lot had been achieved over the last 20 years. "We will not let this stability be reversed under any circumstances," he said. "Pakistan Army will fail the attempts of external as well as internal enemies." The DG ISPR said that the armed forces knew how to defend the institution's integrity and "will give an effective response to internal and external enemies of the state". "We have been fighting conventional wars, then sub conventional wars and now, we are facing a hybrid war," he said. "We know the nature of this war and how to fight it," without specifying the connection of hybrid warfare with the issue at hand. Going off on a tangent, the DG ISPR said that efforts were being made to weaken Pakistan externally. He said that some elements were trying to destabilise the country by making people fight with one another. "Some people are dreaming that they can defeat Pakistan," he said. "This will not happen. If we know about the threat then our response is also in place." The DG ISPR continued, saying that Pakistan Army had successfully defended attacks from abroad and defeated insurgencies in the country. "InshAllah, we will also fight the current design being pushed by anti-state elements," he said. It was not immediately clear if he was talking about the judgement in question or some unrelated matter. He said that the prime minister and army chief had spoken in detail over the verdict. "The army chief met the prime minister and conveyed the sentiments of the armed forces to to him," he said. The DG ISPR said that the government will soon inform the nation about the decisions taken during the meeting between the army chief and the prime minister. He said that Pakistan Army and the government have been working for the past couple of years to take Pakistan into a direction where it is safe from prevalent dangers. "We are taking Pakistan in that direction and we will successfully do so," he said. Justice Yahya Afridi will head the bench conducting the hearing. During an earlier hearing, on March 16, the special court the federal government to put special measures in place to bring the ex-military ruler back from the United Arab Emirates. The special court had ordered that the interior ministry should take action for the arrest of the former military ruler through the Interpol. The court also ruled that the federal government should take measures for the confiscation of Musharraf?s assets and asked the interior ministry to take action to revoke his national identity card and passport. Musharraf, through his counsel, requested for foolproof security upon return to Pakistan in relation to his appearance before the court. The former army chief was indicted in the case in March 2014 after he appeared before the court and rejected all charges. On March 18, 2016, the former president left Pakistan for Dubai for medical treatment after his name was removed from the Exit Control List on the orders of the Supreme Court. A few months later, the special court had declared him a proclaimed offender and ordered the confiscation of his property owing to his no-show.
  19. ISLAMABAD: Former president Pervez Musharraf requested for foolproof security upon return to Pakistan in relation to his appearance in the ongoing high treason case against him. Musharraf?s counsel forwarded a petition to the defence ministry upon the orders of the special court constituted to try Musharraf for treason. The former president?s counsel forwarded the request to the defence ministry. In the petition, it was stated that the former president faced security threats. The special court today ordered the federal government to put special measures in place to bring the ex-military ruler back from the United Arab Emirates. The special court ordered that the interior ministry should take action for the arrest of the former military ruler through the Interpol. The court had asked Musharraf's lawyer to submit a report regarding former president's security within seven days.
