Is it physical, verbal, emotional, psychological or mental? There are too many things here. Millions of men are suffering and they have no way to get out of this. A woman makes one call and the police will grab the man and put him in custody. But I have to go to the cops 20 times and yet they won't do anything. As I said, nobody will believe the man; whatever he says doesn't matter.” He also said that it was he who was in an abusive relationship and added, “I have been abused throughout my relationship. But 90 per cent of my relationship, she bombed me with love; I have never felt so loved in my life. So to say that I was in an abusive relationship, I disregard that.” He also said that he is ready to reconcile with her, “Whenever she comes back to me, my heart will be open”. But they haven’t talked to each other about it because both of them have “too much ego”. He went on to accuse Poonam of infidelity and said, “There is one problem. My wife has all the qualities except loyalty. The Bombay High Court put a partial stay order on one of the provisions of the IT Rules, 2021 and said that the wide terms “bring about a chilling effect on the Right to Freedom of Speech.” The order was passed by a bench of Chief Justice Dipankar Dutta and Justice GS Kulkarni in a petition filed by The Leaflet and journalist Nikhil Waghle. The petition has challenged the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and called them ‘unconstitutional.' The new IT rules came into effect earlier this year and the new guidelines have to be followed by social media websites and digital news outlets. © Reuters The High Court stayed Rule 9(I) and 9(III) of the IT rules which mandates digital news outlets to adhere to a code of ethics and set up a regulatory mechanism that includes an oversight role for the central government. This directly affects the freedom of the press which many critics have called unconstitutional. The High Court agreed with the petition that the new Information Technology Act does not grant power to the central government to regulate news media. The court said that publishers are bound to rules of journalistic conduct of the Press Council of India under the Press Council Act and the Programme Code of the Cable Television Network Act. Even in these acts, a publisher or a journalist is not punishable, the high court said. “It is prima facie difficult to comprehend as to how such fields which stand occupied by independent legislations can be brought within the purview of the impugned rules and substantive action can be taken for their violation under the impugned rules. However, adherence and/or observance of moral standards in the code has been exalted to the status of a mandatory compliance. One who violates the code does so at his own peril and would expose himself/itself to more rigorous action than what the PCI Act envisages," the court said. © Wikipedia Commons The court also pointed out the “chilling effect” the new IT rules can have on digital news outlets if not stayed. Dissent or healthy criticism is a part of democracy which the new IT rules do not encourage news outlets to do. The court said breaking these rules would make anyone think twice before criticising people in public life. The court also called the new rules the “Sword of Damocles” hanging over writers who may not be defaming anyone or even violating any law. “A democracy would thrive only if the people of India regulate their conduct in accordance with the preambular promise that they took while giving to themselves the Constitution. Liberty of thought is one of such promises,” the court said. The High Court said that if certain parts of the new IT Rules are not stayed, it would have a “pernicious effect” and would generate fear for violating the new code of ethics rules. “People would be starved of the liberty of thought and feel suffocated to exercise their right of freedom of speech and expression if they are made to live in present times of content regulation on the internet with the code of ethics hanging over their head as the Sword of Damocles.” After staying Rule 9(1) and Rule 9(3) of the IT Rules, 2021, the court will now take the case for hearing on September 27th. Earlier this week, Shilpa Shetty had filed a plea with the Bombay High Court, asking the honourable court to order certain media outlets to take down articles that were written about her and her alleged involvement in Raj Kundra’s porn scandal. © BCCL The plea alleged that the articles published by the media outlets on their website and social media platforms were defamatory, because of which she was seeking damages to the tunes of Rs 25 Crores. © Instagram/theshilpashetty The Bombay High Court upon hearing the plea has decided to not restrain media outlets from writing about her. The court also said, that since most of the reports cite police sources and have been attributed to statements released by the police, they cannot be considered to be defamatory. © Instagram/theshilpashetty The main contention that Shetty had were against the reports that claimed that she broke down and started shouting at her husband Raj Kundra, when the police searched their properties and house. Shilpa’s lawyer argued that these incidents were “something that happened between a husband and wife, and should not have been reported.” Justice Gautam Patel said that agreeing with what Shilpa Shetty is seeking in her plea will “have a chilling effect on the freedom of the press.” © BCCL Justice Patel also added that since Shilpa Shetty had chosen public life, her life would be under a microscope. He added, “Articles saying she cried and fought with her husband when her statement was recorded, is not defamatory. The court, however, did order the removal of a few video posts that made a few derogatory comments about the actress. The Union Information & Broadcasting Minister Prakash Javadekar announced on Sunday that IIT Bombay, in collaboration with his ministry has decided to form a Centre of Excellence for video games development courses. The centre will offer courses on VFX, gaming and animation and are expected to commence from this year itself. "We're at an advanced stage of preparations,” the Union Information & Broadcasting Minister said. © Reuters Lately, India has released some homegrown games like Raji: An Ancient Epic, FAU-G and other games that have received accolades and attention from the world media and Indian gamers. However, the Indian game development industry is still not at par with other countries at the moment which could be the reason behind the new initiative by the Union Information & Broadcasting Minister. FAU-G’s rocky launch was a testament to the sub-par quality of games made in India. Having said that, there is always an exception to the rule where games like Raji: An Ancient Epic received high acclaim and good reviews from players and showed that games made in India can indeed offer a good experience. © tarun-savvy-unsplash However, Javadekar did mention that many mobile games are "violent, explicit and addictive,” and the government plans to promote Indian cultural ethos in games. "Prime Minister Narendra Modi is passionate about preserving and perpetuating Indian values, heritage and cultural ethos and is putting in the immense effort so that the children and youth of our country are made aware of our rich culture and tradition," the minister said. "We can also introduce those values via modern technology and put it to optimum use," he said. "PUBG was just one example of it, but criticising those games is not the solution. The solution is to create our own games and apps in line with #MakeInIndia for the world so that these are adopted the world over for their basic values that are an integral part of our Indian ethos," Javadekar said. © Reuters It would be interesting to see which courses will be offered in each aspect of game development. Nonetheless, it is reassuring to see the Indian government taking game development seriously. Currently, mobile games dominate the Indian market, however it was not made clear whether the new courses will be specific to mobile gaming or console/PC gaming development. India is currently the world’s fastest-growing mobile gaming market where it has been growing 22% annually and is expected to be worth $1.1 billion by this year as per a recent Google-KPMG study. In another shocking ruling, the Nagpur bench of the Bombay High Court has held that “the act of holding a girl's hands and opening the zip of pants will not come under the definition of sexual assault” under the Protection of Children from Sexual Offences (POCSO) Act 2012. Yes, you read that right. Holding girl's hand, unzipping pants doesn't fall under purview of 'sexual assault' or 'aggravated sexual assault' of POCSO Act; at the most, it falls under 'outraging modesty', 'sexual harassment': Bombay HC — Press Trust of India (@PTI_News) January 28, 2021 Instead, the act comes under the ambit of “sexual harassment” under Section 354-A (1) (i) of the Indian Penal Code, observed the bench. Here’s what happened The ruling was pronounced by a single bench of Justice Pushpa Ganediwala in a criminal appeal against the conviction and sentence awarded to a 50-year-old man for molesting a five-year-old girl. The Nagpur bench of the Bombay High Court ruled that holding the hands of a minor girl and opening the zip of her pants does not fall under the purview of 'sexual assault' or 'aggravated sexual assault' of the Protection of Children from Sexual Offences (POCSO) Act. The observation was made by a single bench of Justice Pushpa Ganediwala on January 15 while passing an order on an appeal filed by a 50-year-old man challenging a sessions court's order convicting him for sexually assaulting and molesting a five-year-old girl. The convict, Libnus Kujur, was in October 2020 convicted under sections 354-A (1)(i) (outraging modesty) and 448 (house-trespass) of the IPC and sections 8 (sexual assault), 10 (aggravated sexual assault) and 12 (sexual harassment) of the POCSO Act. He was sentenced to five years in jail. In her judgement, Justice Ganediwala noted that while the prosecution has established that the accused entered the house of the girl with an intention to outrage her modesty or sexually harass her, it has not been able to prove the charge of 'sexual assault' or 'aggravated sexual assault'. The high court noted that the definition of "sexual assault" under the POCSO Act says that there has to be "physical contact with sexual intent without penetration". "The acts of 'holding the hands of the prosecutrix (victim)', or 'opened zip of the pant' as has been allegedly witnessed by the prosecution witness (mother of the girl), in the opinion of this court, does not fit in the definition of 'sexual assault'," Justice Ganediwala said. The high court further said that the facts of the present case are not sufficient to fix the criminal liability on the accused (Kujur) for the alleged offence of aggravated sexual assault. "At the most, the minor offence punishable under section 354-A(1)(i) of the IPC read with section 12 of the POCSO Act is proved against the appellant (Kujur)," the court said. When the mother returned from work, she found the accused holding the hand of her daughter with the zip of his pants open. The mother, while recording her evidence in the lower court, had said that her daughter had informed her that the accused person had removed his private part from the pant and asked the victim to come to bed for sleeping. The high court ended Kujur's conviction under sections 8 and 10 of POCSO Act, but upheld his conviction under the other sections. Another judgment passed by Justice Ganediwala this month acquitting a 39-year-old man for groping a minor girl, noting that there was no "skin-to-skin contact with sexual intent" has faced severe flak. The Supreme Court had, on Wednesday, stayed operation of this order after Attorney General KK Venugopal mentioned the matter submitting that it was a very “disturbing conclusion” by the Bombay High Court.   9. 2021 hasn't started on a good note for Sonu Sood as he has been embroiled in controversies. Sonu, who was once called a 'messiah', is now being addressed as a habitual offender for carrying out unauthorized construction work at a residential building in Juhu despite demolition initiated twice previously, according to the Mumbai civic body. Maharashtra: Brihanmumbai Municipal Corporation (BMC) has filed a police complaint against actor Sonu Sood (in file photo) for allegedly converting a six-storey residential building in Juhu into a hotel without BMC's permission. pic.twitter.com/49FU1Y3iGJ — ANI (@ANI) January 7, 2021 The affidavit read as "The appellant is a habitual offender and wants to enjoy the commercial proceeds of the unauthorized work and therefore once again started reconstructing the demolished portion to make it operational as a hotel albeit illegally and without permission from the License department." It further stated, "The appellant has not been given permission for change of user of the said property from residential to commercial and there is no license to run the commercial hotel. The appellant, who has totally modified an entire building unauthorisedly into a hotel, is running the same without a license." BMC had earlier registered a police complaint against actor Sonu Sood and his wife Sonali Sood for allegedly converting his six-storey Mumbai building into a hotel without permission. Meanwhile, Sonu had replied to the complaint filed by BMC stating, "I have already taken approval for the change of the user from the BMC. It was subject to the approval of the Maharashtra Coastal Zone Management Authority (MCZMA). This permission has not come due to Covid-19. There are no irregularities. I always abide by the law. This hotel was used to house Covid-19 warriors during the pandemic. If the permission doesn`t come, I will restore it to a residential structure. Recently, a petitioner alleged that the actor has been spreading animosity between communities and has been hurting his religion through her tweets. Ali Kaashif Khan Deshmukh said, “I am a Maharashtrian, Mumbaikar and she calls the court Pappu Sena. This hurts me and that is a personal injury." The court asked the petitioner how reasonable restrictions could be put on her freedom of speech as per Article 19 (2) of the Constitution based on her allegedly offensive tweets. A division bench of Justices SS Shinde and MS Karnik asked the Maharashtra government’s lawyer, Jayesh Yagnik, who said, "This petition needs to be converted into a Public Interest Litigation (PIL), otherwise many people will read newspapers and start coming to the court stating they are hurt. Constitutional right and constitutional remedy are different. This is a vague petition." Considering this situation, a Bombay High Court judge is being hailed as a midnight crusader for clearing backlog cases by going beyond his duty and hearing the pleas till the wee hours of 3.30 am. © Twitter Justice Shahrukh J Kathawalla cleared around 122 cases in over 16 hours on the last working day before the summer break, hearing pleas and delivering results for those who sought urgent interim reliefs. "The courtroom was packed with senior counsels, lawyers, and litigants, whose matters were being heard. There were over 100 civil petitions that had sought urgent interim reliefs," a senior counsel present in the court said. "Justice Kathawalla, even at that hour (3.30 am), was as fresh as one would be in the morning. My matter was one of the last ones to be heard. Even then the judge heard our arguments patiently and passed orders," another senior counsel, Praveen Samdani told NDTV. © Twitter While these kind of speedy and swift administration hearings are unheard of in the Indian justice system, not many were impressed with Kathawalla's style of functioning. “Sitting beyond court hours and certainly through the night causes a lot of inconvenience to a large number of advocates, paralegals, and their staff as well the court staff and administration. Therefore, despite the great work he is doing, it raises issues of institutional functioning,” complained Bombay Bar Association president Milind Sathe. Sona Mohapatra was invited to perform at Mood Indigo, a fest by IIT Bombay. Only, there was condition. A ‘non-negotiable condition’. She had to have a male artist by her side if she were to perform. Even though they didn’t say it, it was obvious how the only women who had ever performed at their fests were either accompanied by a man or were signed up for unpaid gigs. One of the most talented female musicians in the country today was told she needed a man to perform. Think she didn’t need to be tell the world about it? Well, she did. She really did. Because it was much deeper rooted in the system than it seems. A ‘MAN’ needs to be clubbed in on the marquee to validate my stage, a paid stage in particular. A SOLO FEMALE headliner? Want to be paid a price? Just not possible. The ‘men’ have homes to support, we women just ‘work’ for ‘fun’! Don’t believe me? Go through your festival line-ups year after year, decade after decade & you will see this clear as day. You are people with a scientific temper who understand statistics & the like? You’ll see the SAD truth slap you on the face. It’s boys, boys & only more boys. The payment part is not so obvious & for now you will all just have to take my word for it. ?? Does it effect me personally? Am I shedding tears of sadness about missing this great opportunity to entertain & blow your minds with my act? NO, not really. No colleges except the ‘ladies only campuses’, as usual. Why even write this letter then? Well, it is gut wrenching & it takes effort & all the love in my heart for my country to do so. That the premiere educational institutes of the country are blindly propagating such values while the government is putting a spotlight on the plight of the ‘Beti’s’ in the country in their public campaigns in 2016 is ironical. You have no business being in the business of education using this country’s tax-payers money when you do not pursue its constitutional ideals. I am proud of the fact that I do not add ‘glamour’ in other music directors ‘troupes’, get any work from them whatsoever & have yet lasted out & am playing 2-3 hour uncompromising concert sets in the biggest stages of the country. I am the most proud of the fact that my audience & fans love me for my own music & for being myself. My work with Ram Sampath is basis an equal work partnership where both of us contribute to a project, 50/50. Nothing more, nothing less. No favours given or taken. Only mutual respect. I have a young band of amazing musicians, all men at this point & all of whom have no issues backing a female solo artiste. In fact, they are unaware of my gender I believe. They tell me when I’m great on stage & are equally okay telling me if I’ve had an off day. I have a life partner who shares the same value & belief system & is unstintingly committed to the cause of equality of all kinds in society. These are MEN amongst MEN. So all in all, life’s great but I do dream & work for a future where we are ALL conscious about fighting for the right thing. Whenever anyone makes me feel like a second-class citizen in my own country, I will call you out. I urge you all to do the same. Everytime you forget that I am indeed equal, I will call you out. I urge the rest of you to do the same. I am asking for all my opportunities basis hard work, merit & talent. Whether you decide to fight back or stay there is entirely in your hands. The same ideology applies to fitness and fat loss in particular. Thousands of fat men are bullied but only a very few of them decide to deal with it positively. This dude from Bombay was fat shamed throughout his teenage.
